Differences between DDoSing/DoSing and hacking

Today we will talk about differences between DDoSing a service and hacking a server.

If you don't know what't DDoS and DoS, go to posts about LOIC and RefRef.
I asume all of we know what the hell is "hacking", now, we are all DoS experts :)

Could be DoS or DDoS considered a type of hacking? I think it is not, at all.
From my point of view, hacking is all actions that uses some security hole to break something in our systems.

By the way, if a guy is lauching a DoS attack, this guy is not breaking anything.
The attacker is not getting any information from our system, he is not thieving, he is not breaking.

Thus, why can be a DoS considered an illegal action? I can't understand that.
I think that arresting a guy for lauching a DoS attack is not correct at all.

I think we can explain it with a example:

===================================================================
You are going home after work.

When you arrive at home, a guy is in your house door, just "blocking" it.
Your door is not broken.
Should be this guy arrested? Is that correct?  I think not.

Instead that, you should think what you did to motivate this guy to block your house door.

You just may use other door or push him out of your door (this is just, reboot a service) and you will be able to use your house normally.
===================================================================

After the example, all of we may agree, DoS should not be considered illegal, because is not damaging anything, right?

  1. To Your 1st question Could DoS or DDoS be considered to be a type of hacking?

Thats a good one and i am gonna say no but it is used by many hackers wanting to prove a point.

    -----------------------------------------------------
As for question number two why can be a DoS considered an illegal action?

Answer is yes it is an illegal action ill explain.

    Explanation:

Ok so ya logonto your internet at home you are watching bbc iplayer for instance and some one Dos attacks you your internet goes offline and you loose what you were watching and cant resume untill the attack / attacks stop this means you are paying for a service from a provider that you no longer have for the time being making you a victim. My point is denial of service is breaking somthing you are paying for and may have been using at the time the saying goes when there is a victim there is a crime were there are no victims there is no crime.

Answer: The problem and what would make this act illegal is the intent of disrupting services of a company and taking action to disrupt that service.

"When you arrive at home, a guy is in your house door, just "blocking" it.
    Your door is not broken."

Answer: If you are on my property and I tell you, "you are not allowed on my property," and you do not leave, you are then trespassing and I will have you arrested. This was a poor example to use to discribe a DoS action, but nice try.

    1. Trying to be more accurate

Is more likely to many people, OUT of your home, next to the door, they are doing nothing -just standing- but and you are not able to enter home.
If you are not able to kick their asses out of your home (reboot your server?) you'll not be able to enter, but, do you think those people may be arrested?
They are just in the street, standing.

    2. Fran, if someone sat in my doorway, I would kick their ass to the point that they could not walk for the time being then call the cops

  3. Blocking my door is trespassing if not harassment. Both of those are worthy of a butt whooping and if cant do that, then you go to jail.

    1. Dear Martin,

Really, it may be harassment, that could take a lot ok discuss about this.
But, I want to focus (like in my previous reply to the Anonymous user) to discuss about the idea to move someone to jail just for standing there, in the street.
They are doing nothing, just standing there, there is any object broken.
So, If some workers who are in demonstrations, strikes and blockades... they are blocking the street!!!!
Do you really put them in jail?

Except they are doing something, they are DELIBERATELY blocking you from entering your own home.
Next time use a better example.

  4. If it's just some dude spamming a server (either by holding down CTRL + R) or using some sort of application, yeah, nothing should happen. But if it gets the extent to the server crashes and is down for days on end, or keeps crashing (by excessive attacks), then something should be done. But not arrested. That's ridicules. In my opinion, if it gets bad enough when something should be done, maybe a warning at first, then minor legal trouble, and going up from there. But immediate arrest, what?

  5. Fran, if workers are protesting and will not allow u know enter the parking lot, then cops will show up and tell them to leave or arrest them

  6. The problem is that if we give them a warning and so on then that will encourage others to do it. There has already been a increase of attack already so by putting a harsh legal action the government is trying to decrease that number. Plus that example of someone standing in front of your door is stupid. Like if I wore to sit on the highway allowing no one to pass of course I should be arrested. Not only am I a danger to myself but to others also. I would also be backing everyone up who need to go to work or need to go to the hospital because their brother is in the back seat bleeding out.
